Terms of Service

When we say "Company," "we," "our," or "us" in this document, we are referring to Zapiwala AI, the company that owns and operates FoziScribe.

When we say "Service," we mean the FoziScribe platform and all associated features, tools, and content.

By creating an account or using the Service in any way, you confirm that:

• You have read and understood these Terms.
• You are at least 13 years of age (or the minimum legal age in your jurisdiction).
• You have the authority to enter into this agreement on behalf of yourself or your organisation.

FoziScribe is an AI-powered audio transcription platform that allows users to upload audio files and receive accurate, timestamped transcripts. The Service is powered by OpenAI's Whisper technology and supports 99 languages.

• Audio transcription in 99 languages with automatic language detection.
• Pause-based timestamp generation.
• Transcript history, download, and copy functionality.
• Credit-based access model with Free, Creator Pro, and Unlimited plans.

• You must sign in using a valid Google account. You are responsible for maintaining the security of your Google credentials.
• You are responsible for all activity that occurs under your account.
• You must not create multiple free accounts to circumvent credit limits. Accounts found violating this policy will be suspended.
• Accounts registered by bots, scripts, or automated methods are not permitted.
• You must provide accurate information and keep it up to date.
• You may not share your account credentials with others.

Free Plan

New accounts receive 10 minutes of transcription credit at no cost. Free credits are a one-time allocation and do not renew.

Creator Pro Plan

Provides 400 minutes of transcription credit per billing cycle. Credits reset at the start of each billing cycle and do not carry over.

Unlimited Plan

Provides unlimited transcription for practical everyday use. Credits reset at the start of each billing cycle and do not carry over.

Fair-use policy: Abusive usage or unusually high generation rates may temporarily pause your transcription access for up to 24 hours. Access resumes automatically after the cooldown period.

Credit Consumption

• Fast mode (gpt-4o-mini-transcribe): 1× credit deduction based on audio duration.
• Best Result mode (whisper-1): 2× credit deduction based on audio duration.
• Credits are deducted only after a successful transcription. Failed transcriptions do not consume credits.

Add-on Credits

Add-on credits are additional credits purchased separately from your plan's regular monthly allocation. Unlike plan credits, add-on credits never expire and do not reset at the start of a new billing cycle — they remain on your account until used.

• Add-on credits can only be purchased and used while you have an active paid plan. They cannot be used on the Free plan.
• When generating content, your regular plan credits are always deducted first. Add-on credits are only used once your plan credits for that cycle are exhausted.
• If your paid plan is cancelled, downgraded, or lapses, any remaining add-on credit balance is preserved, not forfeited — it simply becomes unusable until you re-subscribe to a paid plan.
• Add-on credits have no monetary value and cannot be transferred, sold, gifted, refunded, or redeemed for cash.

• Paid plans are billed monthly via Razorpay. Prices are listed in USD and may be subject to applicable taxes.
• All payments are non-refundable except where required by applicable law, or at our sole discretion within 7 days of purchase.
• Annual (yearly) plans are strictly non-refundable under any circumstances, including early cancellation or unused credits.
• Where a refund is approved, the refund amount will be the original payment minus any taxes applied on the invoice (e.g. GST, VAT) and any payment processing or transaction fees charged by the payment provider.
• We reserve the right to change plan pricing at any time. We will give existing subscribers reasonable advance notice of price changes.
• Failure to pay for a paid plan will result in downgrade to the Free plan.

You agree not to use the Service to:

• Transcribe, store, or distribute illegal, harmful, threatening, abusive, defamatory, or obscene content.
• Violate any applicable local, national, or international laws or regulations.
• Infringe upon the intellectual property rights of others.
• Upload audio content for which you do not have the necessary rights, licences, or permissions.
• Attempt to reverse-engineer, scrape, or copy any part of the Service.
• Use automated tools to create multiple accounts or abuse the free credit system.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell or commercially exploit the Service without our prior written consent.
• Register any audio generated on the Service with YouTube Content ID, or with any other content-identification or rights-management system. Audio generated on the Service is licensed non-exclusively and may be licensed to other users. Registering it asserts an exclusivity you do not hold and causes automatic copyright claims to be filed against other creators. This includes enabling Content ID or YouTube monetisation when distributing audio through a music distributor.
• Resell or redistribute generated audio as a standalone audio product, or include it in a music library, catalogue, or stock-audio repository.

• We collect your name, email address, and profile picture from Google Sign-In to create and manage your account.
• Audio files you upload are transmitted directly to OpenAI's API for transcription. We do not store your audio files on our servers.
• Transcribed text and associated metadata are stored in your account history.
• We do not sell your personal data to any third party.
• You may request deletion of your account and associated data at any time by contacting us at support@foziscribe.ai.

• The FoziScribe name, logo, design, and codebase are the property of Zapiwala AI. All rights reserved.
• You retain full ownership of the audio content you upload and the transcripts generated from your content.
• By using the Service, you grant us a limited, non-exclusive licence to process your audio solely for the purpose of delivering the transcription service to you.
• You may not reproduce, copy, or redistribute any part of the FoziScribe interface or branding without our prior written consent.

• You may cancel your account at any time from your Profile page or by contacting us at support@foziscribe.ai.
• We reserve the right to suspend or terminate your account immediately and without notice if you violate these Terms or engage in fraudulent activity.
• Upon termination, your right to use the Service ceases immediately. Remaining credits are forfeited and are non-refundable.
• We reserve the right to discontinue the Service at any time with reasonable notice to active users.

The Service is provided "as is" and "as available" without warranties of any kind, including:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Guarantees of transcription accuracy, language detection accuracy, or timestamp precision.
• Guarantees of uninterrupted, error-free, or secure access to the Service.

Transcription quality depends on audio clarity, recording quality, background noise, and the capabilities of the underlying AI model.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.

We reserve the right to update or modify these Terms at any time. When we make significant changes, we will update the "Last updated" date at the top of this page.

Continued use of the Service after any changes constitutes your acceptance of the revised Terms. For material changes that significantly affect your rights, we will make reasonable efforts to notify you via email.

Transcription

FoziScribe uses third-party AI models (including OpenAI Whisper) to transcribe audio. Transcription accuracy depends on audio quality, background noise, accent, language, and the capabilities of the underlying AI model. We do not guarantee 100% accuracy and transcription results may contain errors, omissions, or misinterpretations. You are responsible for reviewing and verifying all transcripts before use.

Image Generation

Image generation is powered by third-party AI providers. Generation requests may fail, time out, or be rejected due to:

• Content policy violations enforced by the AI provider (e.g. prompts containing sensitive, explicit, or restricted keywords).
• High-resolution requests (2K, 4K) that exceed provider processing limits or time out.
• Temporary unavailability or errors on the AI provider's infrastructure.

Credits consumed by failed image generations due to content policy violations or prompt-related rejections are non-refundable. Credits consumed due to a verified platform error may be reviewed on a case-by-case basis by contacting support.

Audio (Text to Speech) Generation

Audio generation is powered by third-party AI providers. Generation results may vary in quality, voice tone, or pronunciation depending on the model used and the input text. Failed generations due to content policy violations or unsupported input are non-refundable.

General

• We do not guarantee uninterrupted availability of any AI-powered feature on the platform.
• Features powered by third-party AI providers are subject to those providers' own terms, policies, and availability.
• We reserve the right to modify, limit, or discontinue any AI-powered feature at any time without notice.

Any FoziScribe account may join the affiliate programme from the dashboard. Joining is immediate; there is no application or review. These terms apply from the moment you join, and continue for as long as you hold an affiliate account.

What you earn

• 25% of every qualifying payment made by a customer you referred, for 12 months from that customer's first payment. Renewals within that window are included.
• Commission is calculated on the sale price excluding tax. Tax collected by our merchant of record is never ours and is not commissionable.
• Rates and durations are recorded on your affiliate account at the time you join. If we change the default terms, existing affiliates keep the terms they were given unless we agree otherwise in writing.

Attribution

• A referral is tracked by a cookie set when someone arrives on your link, valid for 60 days.
• First touch wins. If more than one affiliate refers the same person, the first one is credited, permanently. A later link cannot reassign a customer who has already signed up.
• A referral is only created when the customer makes their first payment. A free signup is not a referral.

Traffic that is not credited

The following earn no commission, and referrals arriving this way are refused at the point of the click:

• Traffic arriving directly from a search engine, including paid search. This prevents bidding on the FoziScribe brand name to intercept customers who were already looking for us.
• Coupon, deal, voucher and cashback sites.
• Referring yourself, or any additional account you control.
• Domains, handles or advertising that imitate FoziScribe or imply you are us.
• Unsolicited email, spam, or any placement that breaches a platform's own rules.

Payment

• You must provide the PayPal email address commissions are sent to. Changes to that address are reviewed by us before they take effect, and every change is recorded on your account.
• Each commission is held for 30 days after the payment that produced it, to cover refunds and chargebacks.
• Payouts are made on the 15th of each month, covering commissions that have cleared that hold, provided your cleared balance is at least $25. A balance below that carries forward.
• Commissions are recorded and paid in US dollars. Any currency conversion, PayPal fee, or charge levied by your own provider is yours.
• You are responsible for any tax due on what you earn. We do not withhold tax and do not provide tax advice.

Refunds and reversals

If a payment is refunded or charged back, the commission on it is reversed. If it had already been paid to you, we may deduct the amount from your next payout.

Suspension and closing the programme

• We may suspend an affiliate account at any time, in particular where the rules above are broken. Suspension stops future earning; it does not remove commissions already legitimately earned, which remain payable.
• Where we find deliberate abuse — self-referral, fraudulent signups, or attribution taken by breaching the rules above — we may void the affected commissions.
• You may leave at any time. Cleared balances remain payable on the normal schedule.
• We may change these affiliate terms, or close the programme, with reasonable notice. Commissions already earned are unaffected.

Your conduct

You are responsible for what you publish. Do not claim to be FoziScribe, do not invent features, prices or results, and disclose that your link is an affiliate link wherever the platform or the law requires it.

FoziQ, FoziScribe's YouTube research tool, uses YouTube API Services. By using FoziQ — including by connecting a YouTube channel — you agree to be bound by the YouTube Terms of Service. Google's handling of your data is described in the Google Privacy Policy.

• Only connect a YouTube channel you own or are authorised to manage.
• FoziQ's access to your channel is read-only. You can disconnect in FoziQ or revoke access from your Google security settings at any time.
• What FoziQ reads from YouTube, how it is used, and when it is deleted are set out in section 12 of our Privacy Policy.
• FoziQ's research is based on public YouTube data and estimates; it is provided as guidance and is not endorsed by YouTube or Google.
